for the Victor Premium Money on Account Program

1. Introduction

   1. These terms and conditions ("Terms") govern the Money on Account Program ("Program") provided by Fly Victor Inc, a corporation organized and existing under the laws of [State], with its principal office located at 10 G Street, NE, Washington, DC 20002 ("Company," "we," "our," or "us").

   2. By participating in the Program, you agree to be bound by these Terms. If you do not agree to these Terms.

2. Eligibility

   1. The Program is available to customers (“Victor members”) who hold an active account with the Company ("Account").

   2. The Program is intended for individuals who are at least 18 years of age and are residents of the United States.

   3. The Company reserves the right to verify the eligibility of any participant and may refuse participation if eligibility requirements are not met.

3. Money On Account

   1. "Money on Account" refers to funds that are prepaid and credited to your Account, which can be used to pay for future flight bookings made by the Victor member.

   2. Money on Account does not constitute a deposit, savings account, or any form of financial service or instrument. It is not insured by the Federal Deposit Insurance Corporation (FDIC).

   3. Money on Account will be held in a secure bank account separate from the checking account of the company.

   4. Money on Account will be treated as a non interest bearing account and the Victor member will not be entitled to benefit from deposit interest.

4. Benefits of the Program

   1. VVIP Client with Dedicated Account Manager and VP Management: Participants in the Program will be treated as VVIP clients, with access to a dedicated account manager and management oversight by the Vice President.

   2. Ease of Booking and Confirmation of Aircraft: Participants will experience a streamlined process for booking and confirming aircraft, ensuring timely and efficient service.

   3. No Risk, Unused Funds Can Be Refunded at Any Time: There is no risk associated with the Program. Any unused funds in your Account can be refunded to you at any time upon request.

5. Adding Funds to Your Account

   1. You may add funds to your Account using the payment methods provided by the Company.

   2. The minimum and maximum amounts that can be added to your Account are as follows:

      • Minimum: $150,000

      • Maximum: $1,000,000

   3. Funds will be credited to your Account promptly upon receipt of cleared payment.

   4. The Company reserves the right to refuse or limit the amount of money that can be added to your Account at any time, at its sole discretion.

6. Use of Money on Account

   1. Money on Account may be used only for the flights and other related service that the Company offers the Victor member.

   2. Money on Account cannot be transferred, assigned, or sold to any third party.

   3. Money on Account cannot be withdrawn or refunded unless specifically stated otherwise in these Terms, or as provided under Section 4.5.

7. Bonus credit

   1. The bonus credit applies against the following categories of the award. The categories and bonus credit is defined as follows:

      1. SILVER, where 3.0% is applied against your deposit being a minimum of $150,000 but not exceeding $299,999;

      2. GOLD, where 3.5% is applied against your deposit being a minimum of $300,000 but not exceeding $499,999;

      3. PLATINUM, where 4.0% is applied against your deposit beyond $500,000.

   2. The bonus credit will be credited to your account when your initial deposit has been fully allocated against fully completed bookings.

      1. This bonus credit will be credited to the Victor Member’s ALTO award points. For avoidance of doubt this allocation can only be used against any future booking after the initial deposit has been depleted.

8. Expiry and Inactivity

   1. Money on Account does not have an expiry date and will remain available for use as long as the Account is active.

9. Refunds and Cancellations

   1. Refunds for purchases made using Money on Account will be credited back to your Account. 9.2 The Company reserves the right to refuse a refund or cancellation if the request does not meet the Company's standard refund or cancellation policy.

   2. Any promotional or bonus funds added to your Account as part of a promotion or special offer may not be eligible for a refund.

10. Amendments to the Program

    1. The Company reserves the right to amend, suspend, or terminate the Program or these Terms at any time without prior notice.

    2. Any changes to the Program or these Terms will be communicated to you via email or by posting on the Company's website. Your continued participation in the Program after such changes have been made constitutes your acceptance of the revised Terms.

11. Data Protection and Privacy

    1. The Company will collect and process personal data in accordance with applicable US privacy laws and the Company's Privacy Policy.

    2. By participating in the Program, you consent to the collection, use, and disclosure of your personal data as described in the Company's Privacy Policy.

12. Limitation of Liability

    1. The Company will not be liable for any loss or damage arising from your participation in the Program, except for any liability which cannot be excluded by law.

    2. The Company makes no representations or warranties, express or implied, regarding the availability, accuracy, or suitability of the Program for your needs.

13. Governing Law and Jurisdiction

    1. These Terms and the Program are governed by and construed in accordance with the laws of the State of Washington.

    2. Any disputes arising out of or in connection with these Terms or the Program will be subject to the exclusive jurisdiction of the courts of the State of Washington.
